Information note pursuant to art.13 of EU Regulation 2016/679 – art.13 of DLgs 196/2003 (Personal Data Protection Code) and subsequent amendments.

In application of the European Regulation no. 679 of 2016 and Legislative Decree no. 196 of 2003 concerning the protection of personal data, we inform you that the Data Controller is You&Me Relax Apartment – via Paese 2G, Avelengo- BZ (hereinafter referred to as “the Controller”).

Personal data are processed in full compliance with EU Regulation 679/2016 and Legislative Decree 196/2003 and subsequent amendments, according to purposes related to the provision of services requested by you (for example: requesting information, registering on the site to receive benefits and offers, obtaining quotes, making payments, making a reservation, exchanging documents). 

Furthermore, the data provided by you may be processed, only with your explicit consent, in order to send you communications of a commercial nature via email or sms regarding the services offered by the Controller.

The data provided by you (hereinafter referred to as “the Data Subject”) will be used solely for the purpose of responding to your requests and may be disclosed to third parties only if necessary for this purpose, or with your express consent.

The processing of the data will be carried out by personnel appointed by the Data Controller using procedures, technical and computer tools suitable for protecting the confidentiality and security of the data of the Data Subject and consists of the collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, cancellation, destruction of the data, including the combination of two or more of the above activities.

The data shall be kept for the time strictly necessary to provide the Data Subject with the requested services and shall in any case be deleted upon the Data Subject’s request, without prejudice to further retention obligations provided for by law.

The data of the Interested Party will not be disseminated.

Within the scope of its activity and for the purposes indicated above, the Data Controller may avail itself of services rendered by third parties in the EU territory who operate on behalf of the Data Controller and according to its instructions, as data processors.

These are suppliers, business and production partners, intermediaries, technical consultants and other similar subjects who collaborate with our organisation in order to fulfil the contractual commitments undertaken with you; subjects who provide a service strictly and necessarily connected to the Controller’s activity such as tax consultants, banks, forwarding agents, insurance companies, public and private bodies, also in relation to inspections or audits; subjects who can access the data by virtue of legal provisions.

The data may also be communicated to all those subjects authorised by law to collect them (e.g. provincial health services companies, financial administration, etc.).

The data subject may request a complete and up-to-date list of the subjects appointed as data processors by contacting the contact person indicated below.

 Right of access to personal data and other rights 

1. The data subject shall have the right to obtain confirmation as to whether or not personal data concerning him/her exist, regardless of their being already recorded, and communication of such data in intelligible form. 

2. The data subject shall have the right to be informed of

 (a) the origin of the personal data

b) the purposes and methods of processing

c) the logic applied in the event of processing carried out with the aid of electronic instruments

d) the identity of the data controller, data processors and the representative designated pursuant to Article 5(2)

e) the entities or categories of entity to whom or which the personal data may be communicated or who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

3. The interested party has the right to obtain

a) the updating, rectification or, where interested therein, integration of the data;

b) the cancellation, transformation into anonymous form or blocking of data processed in breach of the law, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;

c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

4. The data subject has the right to object, in whole or in part

a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;

b) to the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
